Shanghai Foreign Investment Commission Approval Issue (2001) No. 0012
To: Associated Administration Office of Shanghai Diamond Exchange:
Your Request for the Commitment to the Examination and Approval of Foreign Invested Enterprises registered with Shanghai Diamond Exchange (Associated Administration Office of Shanghai Diamond Exchange Synthetic Issue (2000) No. 036) has been received, and notice is made after discussion, as follows:
1. To attract and encourage more foreign diamond traders to enroll in Shanghai Diamond Exchange and carry on diamond transaction, your office is entrusted with the examination, approval and administration of all the foreign invested enterprises that register with Shanghai Diamond Exchange, that carry on such business as rough diamond, finished diamond and finished diamond ornament transaction, diamond import & export, and diamond processing, and that carry out their importation and exportation business via Shanghai Diamond Exchange.
2. Foreign invested diamond processing enterprises that do not register with Shanghai Diamond Exchange shall remain as permitted business, and be examined and approved by respective examination and approval authorities, and their approval shall be reported to the Shanghai Foreign Investment Commission and the your Office.
3. In compliance with the principles of “rights and duties go together” and “those who examine and approve shall be responsible”, foreign invested enterprises examined and approved by your Office, together with their change, capital addition (or reduction), business closing, administrative lawsuit, etc. shall be settled by your Office.
4. Your Office shall appoint special statistic personnel to report the examined and approved projects and recorded registration (including the amount of capital addition) to Shanghai Foreign Investment Commission.
5. For the sake of differentiation, the approval certificate shall bear the initial of “diamond”.
The Notice takes effect from Jan. 1st, 2001.
