To reinforce the management of international freight forwarding enterprises' activity in establishing business branches in Shanghai, and to promote the healthy development of international freight forwarding industry, the following interim suggestions concerning setting up business branches by international freight forwarding enterprises in Shanghai are put forward after discussion:

I.  Applicable scope and title

All the international freight forwarders approved by MOFTEC and registered in Shanghai are eligible if they are in need of setting up business branches in locations other than their registration addresses. They shall complete registration formalities with the Industrial and Commercial Administration Bureaus of the intended districts (counties). The title of all the applied branches shall be XXX Business Branch of Shanghai XXX International Freight Forwarding Co. Ltd. (the business branch can be named after roads or other proper names).

II.  Conditions and requirements

1.         The enterprise must have passed annual examination every year.

2.         Enterprises entitled operation rights in sea transport, air transport and land transport ( motorcade and warehouse are excluded) may set up no more than 3 branches; enterprises running in sea transport or air transport only may set up no more than 2 branches.

III.  Materials required for industrial and commercial registration

1         Testimonial by SMERT (samples attached);

2         Documents needed for industrial and commercial registration (attached)

IV.  Procedure and Place for registration:

1.       Apply to Service Trade Division of SMERT for application form, and fill in the application form;

2.       When other documents for industrial and commercial registration are ready, international freight forwarding enterprises shall complete related formalities in local industrial and commercial administration bureaus (foreign invested international freight forwarders shall go through the formalities on F16, New Hongqiao Mansion, No. 55, Loushanguan Road).

V.  The suggestions take effect from Dec. 1^st, 2000.

International freight forwarding enterprises that have already set up business branches without proper industrial and commercial registration must go through make-up procedures within one month. Otherwise they will be punished according to the regulations concerned.
